Obstructions

Lawrence Tribe, the preeminent expert in American constitutional law, wrote a very interesting column (link here) in the Financial Times yesterday.

He notes that pardons in America have historically been about mercy and forgiveness. Donald Trump's recent pardons, however, are about neither.

Instead, they are of two main varieties: those that are contemptibly immoral and those that are potentially criminal obstructions of justice.

Some pardons within the last ten days fall clearly into the first category: Trump's pardoning of war criminals who slaughtered innocent women and children and his pardoning of rampantly corrupt politicians. These are disgusting and reprehensible but not illegal.

But then comes the other category: pardoning those who aid in hiding Trump's potential crimes. Pardoning someone to obstruct justice is a crime. The fact that a President has pardoning power, like a governor, does not mean that using that pardon to obstruct justice is lawful, a common misunderstanding many people have.

Thus, Tribe argues, Trump's suspicious pardons of his cronies must be investigated. There is a long historical precedent for doing so.

Making the Case

Late Friday, The Guardian published a good opinion piece (link here) making the case why Donald Trump should be criminally prosecuted once he leaves office.

There are political issues, certainly, but the idea that a President should not be above the law is paramount. Otherwise, being elected President would confer a lifetime immunity.

Given how Trump considered not being removed after he was impeached as a license to commit more crimes, he likely would do the same if not prosecuted once he leaves office. There's certainly no question he committed at least some crimes, as evidenced by his being identified in court documents as the ringleader in a conspiracy which led to his lawyer being sent to prison.

This issue may ultimately be out of the Department of Justice's hands if the state of New York decides to prosecute Trump for tax fraud and loan fraud once he leaves office. If he's convicted in that proceeding, the federal government might then appear remiss if it failed to prosecute him as well.

As I've noted before here several times, I suspect this is why Trump is so terrified of leaving office. He knows what's waiting once he no longer has the power of the presidency at his beck and call.

The Bankers

Largely lost in the blizzard of Donald Trump headlines this week, what with his many public temper tantrums and corrupt pardoning spree, was the news that his two senior bankers at disgraced Deutsche Bank abruptly quit as state-level criminal investigations into the President's personal finances escalate in anticipation of his White House exit next month (details here and here).

What this exactly means is not clear at this point but there's a good chance it's a bad development for Trump. It could signal that the two bank executives will be soon indicted themselves (or have already been indicted) and, after alerting their employer about that fact, were given the opportunity to resign rather than be fired.

Alternatively, the duo may not be facing criminal charges but the intense law enforcement scrutiny could have uncovered violations of bank policies which necessitated their departure. They are also very likely to be facing grand jury subpoenas for their testimony, if that hasn't happened already.

At a minimum, one thing is all but certain — neither of them owe any loyalty to Trump. If pushed by prosecutors, they won't fall on their own swords to save him. And chances are they know things that could be very bad news for him if told to a grand jury.

Chances are Trump knows more about what's going on with the state investigations than has been made public. And that may be why he's so terrified of leaving the White House on January 20.

Lashing Out

Axios published one of their trademark juicy, brief pieces yesterday (link here) about how an panicking Donald Trump is lashing out at anyone in his inner circle who doesn't yes-man his increasingly bizarre conspiracy theories.

Although he's famously disloyal to even his most loyal of subordinates, his demands for total loyalty have escalated with fewer interested in staying in the club. The greatest disgrace in Washington is not death, it's losing an election and Trump is learning that now.

Some will still be fiercely loyal, including members of Congress, because their political survival depends on it. But even his formerly most loyal of underlings, most notably the two Michaels, Pence and Pompeo, are easing toward the exits.

Trump is emotionally more fragile with each passing day and irrational but is there a danger he'll do something extreme? I don't think so. He might try something wacky, but there are enough people within arms reach of him who will stand in the way of something recklessly dangerous to the country.

Every time the subject comes up about Trump's frantic efforts to stay in office, the reason why becomes ever more obvious: because he's terrified of a criminal prosecution and financial ruin.

Dark Winter

The piece proves, without a shadow of a doubt and with example after example, why things are worse here than elsewhere in the world — it's because of Donald Trump. More than four dozen White House officials and Trump insiders were interviewed for the piece both off an on the record.

To add insult to injury, as the article notes, Trump has abdicated caring about or focusing on the pandemic since he lost the election. It's just completely off his radar.

Trump is spending all his time poking into bizarre rabbit holes in hopes of finding some way to stay in office. At the same time, he's all but given up on the job he so desperately wants to keep.

Trump's abysmal handling of the Covid-19 crisis is the best example of why he could never be fit to serve as a ward captain let alone President of the United States. His term ends four weeks from Wednesday, and that can't come soon enough.

The Crack-Up

Yesterday, both Politico and The Atlantic magazines published articles on the same theme: Is Donald Trump going crazy? Since he lost the election, Trump has largely hidden from public view and spent much of his time spinning more and more bizarre conspiracy theories.

The Atlantic's somewhat shorter item (link here) is titled "Trump Is Losing His Mind." Politico's somewhat longer piece (link here) is titled "Is Trump Cracking Under the Weight of Losing?"

Both discuss how Trump's extreme narcissism cannot process the intense humiliation of losing the Presidency. Rather than face that truth, he weaves increasingly surreal conspiracy claims. He cannot accept the reality that he is a big loser, something that will be written in history for all time.

Both articles touch on the mounting legal challenges Trump faces once he leaves office. Neither really dig into a real possibility that I think might exist — Trump is terrified of being prosecuted, convicted, and even sent to prison. For that reason, he's coming apart.

Not only will history record Trump as a big loser, it may also record him as the first American President to face a criminal trial and possible criminal conviction. In short, the former President may soon be a felon.

Trump has run one step ahead of the law his entire life, both in civil law and criminal law. That race may soon end, and it could be with handcuffs around his wrists now that he will no longer be President. I suspect that fact terrifies him.

And that, more than anything, may be the reason he's visibly coming unglued. The presidency is his lifeboat, and without it, he will perish.

Hacked

Since March, Russian intelligence operatives have hacked into critically important US computer systems, include many run by the American government. When it was first made public this month, his has repeatedly been described as the most serious breech in intelligence history.

Wired magazine has published a comprehensive series of articles about the hack (link here). US government officials, including the Secretary of State and top intelligence personnel, have all identified Russian intelligence as the culprit.

After days of silence on this unfolding crisis, Donald Trump is now trying to blame China and says Russia was not involved (details here). He offers no evidence. He doesn't even know how to operate a laptop or desktop or tablet so he's hardly a computer expert.

US intelligence officials immediately contradicted him behind his back. Security specialists say there's no evidence China was involved and enormous evidence Russian intelligence was responsible.

There have been repeated claims that Trump was long ago compromised by Russia and is a real-life equivalent of the Manchurian Candidate. Such assertions nonetheless seem like something from a novel or movie and not the real world.

But when Trump repeatedly takes Russia's side in matters like this, and contradicts the American government, and bends over backwards to give Russia the benefit of the doubt, time after time after time without exception, wondering if he really is Moscow's puppet seems not so far fetched after all.

Of course, Trump will do nothing about this mess. It will be left to President-elect Joe Biden's administration to sort it all out. Meanwhile, America's computer networks remain compromised.

The Mysterious Shell

Yesterday, Business Insider and the New York Times concurrently broke the startling story (link here and here) that Donald Trump's reelection campaign laundered at least $600 million to $700 million into a mysterious shell company created by Jared Kushner, the President's son-in-law. The company was controlled by the President's daughter-in-law and the Vice President's nephew.

Those hundreds of millions represent half or more of the $1.26 billion in donations it received from Trump's supporters for the 2020 election.

In violation of federal law, the company was created to avoid required reporting of campaign spending to the Federal Election Commission. It also paid Trump's family members as well as some of his top advisors, but the amount of those payments as well as the exact number and identity of recipients is unknown.

The shell company was so mysterious that top-level campaign officials didn't even know its function or what it was doing.

Whether it spent money prudently is also unknown as well. During the final months before the election, Trump's campaign cancelled tens of millions in advertising because it was running out of money.

Per the linked Insider article: "Campaign-law experts have long accused the Trump team of using a corporate pass-through to hide payments. The nonpartisan Campaign Legal Center [in a legal complaint filed with the federal government in July accused] the Trump campaign of 'disguising' about $170 million worth of campaign spending in large part 'by laundering the funds' through] the shell company. After that complaint was filed, roughly $400 million more was laundered through the mysterious shell company.

A Campaign Legal Center official said money laundered through the shell company was a "scheme to evade telling voters even the basics on where its money is really going" and a "shield to disguise the ultimate recipients of its spending."

The Federal Election Commission could fine Trump and his campaign for this tactic. And if the Justice Department suspects that a "knowing and willful" violation of the law occurred, it can open a criminal investigation and, ultimately, file criminal charges against those responsible.

This raises the question of why would a candidate use a secretive shell company in a presidential campaign if it wasn't deliberately designed to hide something in violation of the law? By its very nature it suggests both something illegal was going on and those atop the campaign went out of their way to hide it.

A Major Villain

One side benefit to Donald Trump's decisive defeat in last month's election will be the departure of a whole slew of despicable characters in his administration. Picking who was the worst of the bunch is a formidable tasks because there are so many choices.

One particularly loathsome individual who must rank in the top firmament of nearly everyone's list is Trump's outgoing attorney general, William Barr. To help anyone compiling the long list of Barr's evil deeds, on Tuesday The New Republic helpfully published an article (link here) with the title "Bill Barr Will Go Down in History as Trump’s Worst Enabler." The secondary deck title is "The attorney general could not deliver the corrupt boons the President sought, but it was not for want of trying."

The piece pulls no punches. Right up front, Barr is identified as the person who "did more damage to the rule of law than any other attorney general in American history." That naturally raises a question — was he even worse than Richard Nixon's grossly corrupt attorney general John Mitchell who was prosecuted, convicted, and incarcerated in federal prison for his crimes in the Watergate scandal?

Probably so. Mitchell was evil and deeply corrupt but ultimately a clumsy fool. Barr is evil and deeply corrupt but far more careful. While, like Trump, he completely lacks a moral compass, he's far smarter. Mitchell was easy to prosecute because his crimes were so glaringly obvious, whereas Barr can cloak every heinous action he took as being within the law.

Barr claims to be motivated by a belief in a strong commander-in-chief — he wants a President to be running the show, not Congress nor the Supreme Court.

But Barr's actions have betrayed that goal. He actually wants a President to be entirely unaccountable under the law. He was Trump's worst enabler because he wanted to turn him into an all-powerful President. That's not democratic; that's fascistic.

You'd think that Trump's rampant corruption would have shown him the dangers of that approach. But he was blind to the lesson before him — whether this was intentional or accidental is irrelevant.

An attorney general is supposed to be nearly autonomous from the White House, but Barr ignored that precedent. One is left wondering why, given he wasn't a long-time Trump loyalist and didn't know the President before he was elected. One must surmise it was a quest for power — a more powerful President meant a more powerful attorney general.

That means Barr wasn't merely corrupt and evil. He was also extremely dangerous, far more than John Mitchell ever was.
