Beyond the Bizarre

Late Tuesday, the White House Counsel sent a letter to House Speaker Nancy Pelosi that has been described by legal experts as both bizarre and surreal. In it, he attempt to argue without any legal precedent that the ongoing impeachment inquiry is somehow unconstitutional.

In short, with this letter the White House lawyer notified the House that Donald Trump does not recognize the impeachment inquiry as legitimate and therefore will provide no cooperation, this a week after he said he would fully cooperate. Basically, Trump's position is like a child who hides under the bed in hopes that will somehow thwart a trip to the doctor.

"Despite the fact that [the letter] appears under the signature of the chief lawyer of the White House, the letter reads like some combination of a deeply misinformed seventh-grader’s social studies paper and a rant from Sean Hannity, randomly tossing around terms like 'civil liberties' and 'separation of powers' without any apparent understanding of what they mean," wrote Paul Waldman for the Washington Post (link here).

He continues, noting that the White House "is not saying that they have legal grounds to refuse some particular request Congress has made. They don’t even make a claim of executive privilege. They say instead that the entire inquiry is unfair, and therefore they can reject all of it."

Of course, such a stance is absurd. In fact, such a position is in itself an impeachable offense, and one count of Richard Nixon's impeachment articles was for similar behavior when Nixon tried to stonewall the House.

Writing for NBC about the letter (link here), Michael Conway, a lawyer for the House Judiciary Committee during the Watergate crisis, stated flatly: "The Trump administration’s ill-conceived blatant defiance of congressional demands for the testimony of ... witnesses and documents in its ongoing impeachment inquiry into the Ukraine scandal has dramatically increased the likelihood that the President will be impeached."

And his conclusion is ominous: "The text of the Constitution and history will doom Trump’s flailing effort to escape the consequences of his actions. The House will do its duty, likely giving 100 senators a vote that will determine how each will be viewed by history — and his or her constituents in the elections to come."

Popularity

Jonathan Chait at New York magazine published a great piece yesterday (link here) about why impeaching Donald Trump has turned out to be a lot more popular than the President himself.

Indeed, very recent polling is showing that almost 60 percent of Americans now support the current impeachment inquiry in the House of Representatives. And a plurality supports an actual impeachment and removing Trump from office.

Now that the train is moving along, it's proving that many of the impeachment naysayers were wrong. Too many warned that it was a bad mistake politically and better to wait for the election to get rid of Trump.

But as Chait notes, the naysayers were wrong. Impeaching Trump is turning out to have two possible benefits: first, it may actually lead to Trump being removed from office and, second, even if not, the whole process will badly hurt him politically in the 2020 race.

Chait writes: "Most voters are locked in to one of the parties. The swing vote tends to be low-information voters with a hazy grasp of the issues. Impeachment is a signal to those voters that Trump has done something seriously wrong. It’s not a magic trick that works against every president — there needs to be misconduct people can easily understand, and which the news media covers as a serious scandal. This easily qualifies."

And he closes with: "Having the news dominated by a scandal even many Republicans can’t defend, with a constant drip of damning new details, is extremely unhelpful for the president."

Nicely too, Trump's own behavior is really hurting him now. His tweeting and public statements are borderline insane. And by blocking everyone from testifying before the House, he looks positively Nixonian, like he has something to hide — and something big.

Once again, Trump is turning out to be his own worst enemy. And at a time like this, that's not an enemy one wants to have.

Nine Scenarios

Matt Yglesias put together a fascinating piece for Vox yesterday (link here) where he calculates the nine possible outcomes to the crisis Trump now faces. Some are far more likely than others, and some are truly scary.

People presume that the Senate will fall in line behind Trump and vote the party line. While I would concede that's perfectly possible, I don't think it's a foregone conclusion.

When Richard Nixon resigned in 1974, he did after Senate Republicans told him they had done a nose count and the President could count on no more than twenty — and probably far fewer — who would not vote to remove him during a Senate trial after he was impeached. Yet only a few months earlier, Nixon still enjoyed fairly strong support amongst Republicans on Capitol Hill and also amongst voters.

Release of the most damning Watergate tapes the President had refused to surrender arguably is what spelled Nixon's end. And it was an end that was not visible very far in front of it.

So the same could happen with Trump. Yes, if the Senate vote was today, he probably would survive. But the vote won't be today. It might not be until early next year at the earliest.

And a lot can surface between now and then. Look where we were just a month ago. Impeachment seemed highly unlikely. And then the Ukraine scandal broke. Impeachment went from highly unlikely to highly likely.

If this scandal was a baseball game, we're still in a very early inning. It's far too soon to predict who will win. Many more exciting plays will happen. Stay tuned.

A Second Whistleblower

Yesterday, ABC News broke the story (link here) that a second whistleblower within the intelligence community has come forward and has spoken to the inspector general.

This second individual has reportedly confirmed what the first whistleblower claimed with the added advantage that he/she directly witnessed some of the events in question.

With the first whistleblower set to testify soon in a closed session before the House Intelligence Committee, hopefully soon the second one will do the same.

Yesterday, one of the attorneys representing both whistleblowers hinted during a media interview that there's at least a third and possibly more whistleblowers waiting in the wings.

Spiraling Out of Control

David Graham at The Atlantic wrote a great piece (link here) recapping the now massive scandal at week's end which has Donald Trump and his administration in a vise. If you only have time to read one piece, make it this one, because it puts the whole sordid mess in perspective.

Identifying it as "the most serious crisis of his presidency," Graham deftly lays out the story of how the crisis got increasingly worse as the week wore on. "It is now an all-encompassing scandal, involving many of the top officials in the Trump administration pressuring countries around the world, from Australia to Ukraine and China to Great Britain."

From the perspective of a spectator, it's interesting to me how this new crisis has dwarfed the many other scandals that have dogged Trump since he entered the presidential race. And it nicely shows, yet again, as I've often said here before, that Trump is his own worst enemy.

The Smoking Texts

Late Thursday night, three congressional committees released bombshell texts sent by various Donald Trump appointees showing they made clear to Ukraine's officials that any improvement in their country's relations with the United States was dependent on their help in discrediting potential Democratic rival Joe Biden (details here and here).

This establishes the damning quid pro quo: America will help you but only if you smear Biden.

Bizarrely, Trump claimed later the text messages somehow vindicated him and thus "case closed." His fingerprints are all over the gun and the bleeding body is at his feet, yet he insists the smoking gun somehow clears him. Well good luck with that defense.

This dials up impeachment pressure still further and puts GOP senators in an increasingly tight fix, considering Trump has been privately lying to them about the lack of any quid pro quo (details here). It's worth noting that when Richard Nixon was exposed for having lied in private conversations with Republican Senators, his support began to implode in Congress back in the 1970s.

And fortunately the public is listening. Survey results released yesterday showed that a clear majority of Americans now supports impeaching and removing Trump from office (details here).

This weekend might bring more late-breaking developments from Washington, so stay tuned.

This is not the first time that Trump's actions suggest that he thinks because he does it, as President, it's automatically legal. As Richard Nixon could tell him, he's very much mistaken.

This adds further evidence for the House of Representatives to use in any articles of impeachment they might draft. If Trump actually listened to anyone giving him legal advice, he likely was told that he should not comment in any way on the proceedings, much like criminal defense attorneys do when a client is facing indictment.

To make sure that Trump realized what he was doing was a crime, the chair of the Federal Election Commission later in the day issued a reminder that seeking foreign political help is illegal (details here). That's not the first time she has issued such a warning, but of course Trump never listens to anyone because he thinks he knows everything.

The Other Whistleblower

The answer likely lies in how the public would react to another potentially explosive set of allegations. If it further erodes resistance to impeachment in a big way, as the intelligence community whistleblower has done, that could be enough to start peeling away Republican support for Trump in Washington, specifically in the Senate.

Then it could be like Richard Nixon all over again. Nixon had fairly strong GOP support well into his final months in office, but then suddenly it collapsed as the most serious elements of the Watergate scandal became public. One would hope something similar will happen with Trump, too.

Hearsay Heresy

Ever since the whistleblower complaint was made public late last week, Donald Trump and his apologist have repeated the lie that it's worthless because it's all based on hearsay. (If you need a refresher, hearsay is indirect information about an event or situation as opposed to direct or first-hand information.)

Consider the following hypothetical scenario: John tends bar in a tavern on the state highway. One night when he's working, a man bursts in the door and says, "I just saw a man shoot somebody in the parking lot. He took off into the woods. I'm going after him. Call the police."

Now when John calls the police, the following will happen:

(a) The dispatcher says, "sorry, we can't send anyone out. What you're telling us is all hearsay."

or

(b) The dispatcher sends out police to investigate.

The answer here is obvious — it's (b). That's because while hearsay may be limited at trial, it's perfectly acceptable to consider during an investigation.

On Monday, the Washington Post published a good piece (link here) on this topic (Above the Law ran a similar piece here.) Consider the following short excerpt from the Post article:

"Investigations routinely are begun based on hearsay evidence, tips from confidential informants, newspaper reports, or other information that may not necessarily be admissible in court. There has never been any rule against relying on hearsay to initiate an investigation. The investigation is done to see whether the hearsay can be corroborated — which is exactly what happened here."

And also: "In fact, in the federal court system, hearsay not only may be used to begin an investigation; it may be used to indict. It is common for defendants to be charged as a result of grand jury proceedings that rely on hearsay evidence. Because the grand jury is only making an accusation and not deciding guilt or innocence, the Supreme Court has held that rules against hearsay and other evidentiary rules generally do not apply in grand jury proceedings."

Of course, the truth won't stop Trump and his apologists from repeating their lies. That's because they're panicking and desperate that the end may be near.

Double Breaking

Two important news items broke late yesterday within minutes of each other that likely will add fuel to the impeachment fire now heating up in Washington.

First, the New York Times broke the story (link here) that Donald Trump pressed another foreign head of state for personal favors to help him politically. This time, Trump asked the Australian Prime Minister a few weeks ago for assistance in discrediting the Mueller investigation.

Trump believes it the factual and legal basis for the Mueller inquiry can be discredited, that will help him somehow. The basis of Trump's objections are not that he and his staff acted improperly but that someone dared to report this and investigate him.

Minutes later, the Washington Post broke the story (link here) that, on Trump's behest, the Attorney General has asked a number of foreign intelligence officials to help discredit the Mueller investigation. He's essentially asking foreign intelligence agencies to discredit America's intelligence agencies.

Both Trump and the Attorney General's activities risk weakening America's standing and diplomatic capital simply to help Trump's political prospects. Given how support for impeachment and removal has spiked markedly within just the last week, Trump's belief that discrediting the Mueller investigation, which has been concluded for months, seems patently ludicrous.

Basically, Trump is focusing on selling to his base that's already sold. At the same time, he's alienating the rest of the country more and more, all the while the latter group gets bigger and support for impeachment and removal from office grows.

Trump is dangerously close to the support tipping point now, if he hasn't passed that point already. This happened with Nixon in 1974 when he lost support that was never going to come back. Let's hope the same happens with Trump.
