The Atlantic published an excellent essay on Saturday (link here) written by a law professor about how Donald Trump's attorney general and White House counsel have both thoroughly corrupted their function.

Government lawyers are supposed to represent the United States, not serve as personal attorneys to the President, but that's what's increasingly happening with this administration.

The author includes an excellent example of how the Justice Department recently tried to block release of the intelligence community whistleblower report to Congress, notwithstanding federal law requires that to happen. This was being done to protect Trump, not further the interests of the United States.

The Department issued a memo to justify their defiance of the law, a memo that was classified as top secret. The article's author doesn't mention how that in itself was another violation, a corruption of the secrecy process to hide a memo justifying obstruction of justice and violation of the law.

The number-one culprit here is Attorney General William Barr, who believes a President is above the law, an idea peddled by advocates of the so-called unitary executive theory. He even wrote a detailed legal memo justifying that position and sent it to the White House in an apparent attempt to float his own name as a candidate should the attorney general position become vacant. It soon did and his memo worked.

Arguably, Barr should be impeached and removed from office along with Trump himself. While the latter could possibly happen, I don't think Barr has to worry. This is the second time he's been attorney general (the first time was when the elder Bush was in office). He's tight with the Republican establishment, unlike Trump.

If there's any silver lining here, it's that the Trump administration was so incompetent that it took more than two years to name Barr to the attorney general slot. He's the perfect man for the job if you're a deeply corrupt President like Trump, but it took Trump and his people two years to realize the guy even existed.

Broken Promises

PBS ran a piece on Thursday (link here) about how blue-collar workers who believed Donald Trump's 2016 promises about jobs in the Rustbelt are feeling abandoned now that they realize he was lying.

Indeed, Trump was still making these promises after he was in office, telling people manufacturing jobs were "all coming back. Don’t move. Don’t sell your house."

One of those workers who believed him reveals the truth to PBS: "He lied. He told everybody it’s all coming back. It’s not. It’s harder and harder to find a job."

Now some would criticize such people, saying they deserve everything they don't get because they voted for Trump. I don't agree. I see them as victims of a con artist.

These are people who are not highly educated and who are not politically sophisticated. They live in a world where people keep their promises and live by their word. So when someone guarantees them something, they have every reason to believe it will happen, even if that seems hopelessly naive to more worldly people.

Nevertheless, they were conned and deliberately so. Trump feels no shame in manipulating such people and then discarding them.

Their stories need to be told in 2020 and repeatedly. They are the reality Trump delivered on his broken promises. They need empathy so that others like them won't make the same mistake again and vote for Trump twice.

Unmoored

The Atlantic published an excellent essay yesterday (link here) about how Donald Trump is becoming increasingly erratic and unhinged and is likely to become all the more so as the impeachment noose closes around him.

All reports indicate Trump is increasingly isolated from anyone except for sycophants. He has no personal life to speak of, other than cheating at golf. "I think what we’re viewing, if you think about the human side of it, is the man has no life," the article quotes a close confidante. "He just has no life."

One is reminded of Richard Nixon in the darkest days of Watergate. He drank alone and heavily and wandered around the White House late at night, talking to portraits of former Presidents hanging on the walls.

One need only look at Trump to see how miserable he has become (example here). He also looks like he's completely zonked by sleep deprivation.

The silver lining to all this is that the more visibly unmoored Trump becomes, the more that will hurt him in next year's election. People who were fooled by him in 2016 will be far less inclined to be fooled a second time.

Another Very Bad Day

Yesterday was another very bad day for Donald Trump and his administration, made all the more so by several major unforced errors.

In an extreme self-wounding act that can't be undone, Trump's chief of staff admitted openly to reporters that the President had broken the law when demanding a campaign favor from Ukraine in exchange for the release of foreign aide, but not for the reason everyone has been saying (details here and here).

Once you admit committing a crime, quibbling over the motive becomes immaterial. Motive only comes onto play when a party pleads not guilty. Not surprisingly, the admission enraged officials at the Justice Department and inside the White House.

And yesterday, another member of Trump's own administration appeared on Capitol Hill before the House Intelligence Committee and gave damning testimony that will hurt Trump in the all-but-certain impeachment action now pending. More than a few publications reporting on the event noted how the former Trump loyalist threw the President and his attorney "under the bus" (details here and here).

Syria and the Turkish invasion continued to be a nightmare for Trump. After the President sent an extraordinarily embarrassing letter to the president of Turkey, he completely caved to their position and allowed the much smaller nation to bully the United States (details here). As the linked article notes, "Trump was bragging about what he considered to be a sign of his own brilliance without realizing that it was instead evidence of abject failure."

And last, but certainly not least, in an episode that shows how clueless Trump and his inner circle are about the crisis in which they're drowning, the White House announced yesterday that the next G-7 international conference of world leaders would be held at one of the President's own golf courses, a move that will enrich him by countless millions. As one Washington pundit put it, the decision was worthy of impeachment all on its own.

ProPublica broke a major story yesterday (link here) when it published details from some of Donald Trump's never-before-seen documents which revealed he claimed far higher income for loan applications than he did for city tax filings. The documents also show Trump significantly overstated materially important occupancy numbers for some of his buildings in lender packages.

This suggests Trump may have committed tax fraud or loan fraud — or both. And it also suggests the reason he has been so stridently opposed to releasing any tax returns — if he cheated in city tax filings, he very well may have done the same thing with his state and/or federal tax returns and thus publishing them would subject him to far greater scrutiny by a variety of lenders and tax authorities.

According to the ProPublica article, Trump's dodgy numbers "made the buildings appear more profitable to the lender — and less profitable to the officials who set the buildings’ property tax. For instance, Trump told the lender that he took in twice as much rent from one building as he reported to tax authorities during the same year, 2017."

The piece continues: "A dozen real estate professionals told ProPublica they saw no clear explanation for multiple inconsistencies in the documents. The discrepancies are 'versions of fraud,' said Nancy Wallace, a professor of finance and real estate at the Haas School of Business at the University of California-Berkeley. 'This kind of stuff is not OK.'"

This is not the first time such allegations surfaced. Michael Cohen, Trump's former attorney and fixer, testified in February that Trump falsified his income on loan applications (details here).

The ProPublica article was entirely sourced from publicly available documents, which included New York city tax filings obtained with a freedom of information request. The loan documents were found in public filings from when Trump's lender sold the debt on his properties as a package of mortgage-backed securities.

Hopefully this article will inspire other journalists to dig around in publicly available materials to learn more about Trump's shady and possibly criminal practices. And, hopefully too, these revelations will inspire law enforcement personnel to look more closely at some of Trump's business practices.

Tumbling Down

Donald Trump's house of cards appears to be tumbling down. As Axios reported yesterday (link here), Trump's attempts to block key members of his administration from testifying on Capitol Hill in the impeachment inquiry are failing.

"The White House is tense — and some aides are frantic — as Democrats on Capitol Hill tap a gusher of revelations," the Axios piece notes.

Over at Politico, they're painting an equally bleak picture for Trump where the headline for a piece yesterday (link here) reads "Trump’s impeachment barricade crumbles" and the sub-headline says "Key witnesses are ignoring Trump and delivering bombshell testimony in Democrats’ Ukraine investigation."

Indeed, several days last week every day this week has featured a major witness testifying for nearly the entire day in closed door Intelligence Committee hearings. Witnesses will continue into next week at least.

One Democratic member of Congress is quoted as saying: "The walls are closing in. The details we are learning about the shadow foreign policy operation Trump has been running to benefit himself personally are stunning."

The big unanswered question now is whether John Bolton, until recently Trump's National Security Advisor, will also testify. He is known to have expressed strong objections to Trump's Ukrainian corruption, and given he departed the White House not on good terms, he has every incentive to speak his mind.

The Intelligence Committee will soon begin releasing transcripts of the closed-door testimonies. That could prove to be explosive. Stay tuned.

The two biggest winners from Trump's decision was none other than the Russian dictator Vladimir Putin and the ISIS terrorist group, given US forces under the President's orders are almost fleeing the country. The Kurdish region was previously free of ISIS presence, but that will soon change with the Turkish invasion of Syria already underway where they are targeting their traditional Kurdish rivals.

Two Washington columnists wrote scathing op-eds yesterday about Trump's bizarre decision. The first is titled "Trump has delivered what Russia wants in Syria — at zero cost — and 'Putin likely can't believe his luck'" (link here). The other is titled "Trump hands Putin another win with Syria pullout" (link here).

I've said before that I've always been skeptical about the theories Trump is some sort of Manchurian Candidate controlled by Putin. But when he, yet again, does something like this that benefits Russia while hurting America, you have to wonder what's really going on.

The Loophole

The Washingtonian published an interesting piece last week here about how, if Donald Trump is impeached, it isn't necessary for two-thirds of all Senators to vote to remove him.

It only requires a two-thirds majority of whomever is present to vote him out. So if ninety Senators show up, only sixty need vote to remove him. Or if eighty Senators show up to vote, only fifty-four are needed to remove him.

Voting "remove" will be very hard for Republican Senators to vote because they fear backlash from their base. Unless, of course, sentiment tilts further away from Trump now, as happened in the final months of Nixon's presidency.

The unanswered question is whether not showing up to vote would be as damaging as voting to remove.

Still, I have to say something like this happening seems like a long shot. It's not impossible, but I don't think we can count on it as being something with a strong chance of happening. Still, a lad can dream.

It is, nonetheless, an interesting idea.

The Mirage

Donald Trump has openly and repeatedly crowed that the Republican-controlled Senate will vote to keep him in office should the House of Representatives vote to impeach him.

Richard Nixon thought the same thing in 1974, convinced that the Democrat-controlled Senate of the day would not muster enough GOP votes to clear the two-thirds hurdle to remove him.

And then suddenly, in the span of a week, that surety was gone. The Senate was expected to have at least eighty out of a hundred votes in favor of removing him, far more than was needed, with many abandoning Nixon.

As Politico notes in a thoughtful piece published on Friday (link here), the same could happen to Trump. The support he thinks he has now will not hold if the public turns against him by larger numbers once an impeachment hearing and then trial are underway. Today's support is no panacea for tomorrow's troubles.

No one knows what the future holds. The only thing certain is uncertainty.

Double Dunked

Yesterday, Donald Trump suffered two major court defeats.

In one case brought in federal court in Texas, a judge ruled that his national emergency declaration as a means to build a border wall was unlawful (details here). Because the ruling came from a trial-level judge, it goes without question that the Trump administration will appeal the ruling.

In the other case, an appellate court ruled that Trump's accounting firm must turn over eight years of his tax returns to the House Committee on Oversight and Reform (details here). The appeals court upheld the same ruling from the federal district court. Of the two cases mentioned here, this one potentially has wide-reaching implications for the President.

Trump can now ask the same appellate court to reconsider the matter or seek review by the Supreme Court. The appellate court review is mandatory if requested but the Supreme Court is not compelled to take up the matter should Trump attempt to appeal directly to them.

The chances that Trump will prevail if he goes to the high court are not good. He also has lost his attempt to block the Manhattan District Attorney from receiving his tax returns, a matter which now is under appeal to a different federal court.

In short, Trump has lost every one of his tax cases. Then again, this exhaustive litigation likely is not designed to address the merits but simply to delay the inevitable.

However, given court schedules, the matter may be decided in the middle of the 2020 campaign, which could turn out to be particularly embarrassing for Trump. So he may be winning some battles by continuing to file appeals after losing, but eventually he may lose the war.
