The Warning

The Wall Street Journal broke the story last night (link here, mirror without paywall here) that Donald Trump's now retired longtime lawyer, who represented him for decades, has warned the President that his current attorney and fixer Michael Cohen, whose offices were raided by the FBI and now faces possible criminal charges, will cooperate with prosecutors and flip on his client.

The long-time lawyer, Jay Goldberg, according to the article, "cautioned the President not to trust Cohen. On a scale of 100 to 1, where 100 is fully protecting the president, Cohen 'isn’t even a 1,' he said he told Trump." Goldberg spoke directly to The Wall Street Journal on the record to confirm the call.

The piece goes on to note that Goldberg "said the volume of correspondence taken and the potential pressure the government can bring to bear on Mr. Cohen to testify put the president in more potential peril from the Cohen matter than from special counsel Robert Mueller’s investigation."

While Cohen has made public statements that he would never betray Trump, Goldberg isn't buying things would stay that way, given federal prosecutors in Manhattan have a long history of flipping reluctant mob witnesses.

If Cohen does eventually flip, this could be as significant as when Richard Nixon's lawyer John Dean flipped on him and sang like a birdie to prosecutors -- or possibly even bigger. Dean arguably did the most damage to the President of the many witnesses who testified against him.

Of course, all this discussion compels us to ask "If Trump didn't break any laws nor commit any crimes, why is he so worried that the Cohen investigation will be his undoing?"

Whistling Past the Graveyard

The American Prospect published an excellent piece yesterday (link here) with the title "Trump’s Impotent Rage" and the subtitle "The window for firing Rosenstein or Mueller, and getting away with it, has closed."

Special Counsel Robert Mueller, who leads the criminal investigation into Donald Trump and his associates, brilliantly played the President when he handed off investigation of Trump's lawyer/fixer Michael Cohen to the U.S. Attorney for the Southern District of New York. The latter looks likely now to charge him with no less than bank fraud, wire fraud, and violations of campaign finance law and possibly much more.

So if Trump ordered subordinates to fire Mueller, the Cohen investigation and prosecution continues untouched because it's in an entirely separate office and can't be stopped by the President nor the Justice Department.

As the Prospect piece notes: "A President with broad political support might have illusions of quashing all such investigations, but Trump lacks the political support, and firing Rosenstein and Mueller would further erode what remains of his political backing, even among Republicans."

The piece moves on to discuss what the writer calls "a long-deferred crisis for the Republican Party" -- specifically, the Trump millstone hanging around collective GOP necks. They have been whistling past the graveyard for so long when it comes to Trump's behavior and corruption that they're now in a very bad place and an angry majority of voters is staring them down.

The Prospect article brought to mind another excellent piece that ran in The New Yorker over the weekend (link here) with the title "Michael Cohen and the End Stage of the Trump Presidency."

There, the writer notes "there are lots of details and surprises to come, but the endgame of this presidency seems as clear now as those of Iraq and the financial crisis did months before they unfolded....This is the week we know, with increasing certainty, that we are entering the last phase of the Trump Presidency. This doesn’t feel like a prophecy; it feels like a simple statement of the apparent truth."

Trump is in a corner with nowhere to go. This is the final act of his presidential farce. The final act may go on a long time -- far too long, in fact.

But it won't get any better for him. And, almost certainly, a lot worse. It will the darkest just before dawn. Stay tuned.

Devastating Defeat

Yesterday afternoon, a federal judge in Manhattan handed down a evastating defeat for Donald Trump and his attorney/fixer Michael Cohen (details here), the latter whose offices were raided by the FBI last week. Cohen's attorneys filed for an emergency restraining order last week to stop prosecutors from reviewing the seized and voluminous material.

Yesterday's ruling blocked that attempt, meaning prosecutors and not Trump nor Cohen are in the driver's seat on this matter. Trump is one of Cohen's only three clients, so the presumption is that a significant majority of the seized material relates to the President.

Various news outlets have already reported that Cohen, who is now the subject if a federal criminal investigation, was an essential facilitator in white collar crime on behalf of Trump. It has been widely reported that Trump now fears the Cohen matter will be his undoing, not the Mueller investigation. The case is being handled by the Manhattan Division of the US Attorneys' Office.

Cohen's files, now in the hands of federal investigators, may turn out to hold the smoking gun that ends the Trump presidency. Stay tuned.

A Quick Death

The Daily Beast published a well written and optimistic article on Saturday (link here) with the title "LGBT ‘Conversion Therapy’ Is Dying a Quick Death Across America. Good."

The article notes that a number of primarily coastal states and jurisdictions have recently outlawed conversion therapy thanks to bipartisan support. The bad news, however, is that the heartland of so-called red states has been largely intractable on this issue.

Refreshingly, while the United States often lags Canada and Western Europe on social issues, the Yanks are on the vanguard of this issue while the Canucks and Euros lag behind and are slower to ban the practice.

The Republican-controlled Congress in Washington, however, has shown no traction on this issue. Democrats have introduced ban legislation, but then it dies a slow death through legislative inaction, thanks to the GOP.

Some studies have shown that less than 5 percent of Americans have a positive impression of conversion therapy, while more than half of Americans have a deeply negative opinion. It is therefore disheartening to realize that conservative politicians are pandering the very small fraction of the populace while ignoring the vast majority on this issue.

The Second Front

The New York Times published an article late Friday night (link here) about how Trump lawyer Michael Cohen's criminal case presents a greater legal challenge to the President than Mueller's criminal investigation.

This is also the perception inside the White House, as the piece notes: "Trump’s advisers have concluded that a wide-ranging corruption investigation into his personal lawyer poses a greater and more imminent threat to the president than even the special counsel’s investigation."

Donald Trump has talked privately with friends about firing both the Attorney General and the Deputy Attorney General and replacing them with individuals who will fire Special Counsel Robert Mueller. Trump cannot do this directly himself because of technical legal reasons.

But even if Justice Department leadership is swept aside and Mueller is fired, the Cohen investigation and possible prosecution won't stop because that isn't even being handled by Mueller's special staff. That's one of many criminal cases handled by the Manhattan division of the U.S. Attorney's Office, which prosecutes all sorts of suspected federal crimes.

This week will undoubtedly see more developments in this fast-moving story. Stay tuned.

Holy Hell

A big legal fight has broken out between the Justice Department and Donald Trump's personal lawyer Michael Cohen, the latter whose office, home, and hotel room were raided earlier this week in a dramatic search that resulted in the FBI hauling away scores of files, computers, electronic equipment, and much more.

The Department of Justice revealed yesterday that Cohen himself has been under criminal investigation for months (details here).

Trump's lawyer is trying to claim everything seized is protected by attorney-client privilege, but the Justice Department has asserted, per a Reuters article yesterday (link here, mirror here), that an initial review of seized emails show that Cohen "is in fact performing little to no legal work."

A number of news reports on Cohen's actual work this week suggest he's really Trump's fixer, not his lawyer, and takes care of making messy problems go away, which includes paying people off to keep quiet and, at times, threatening them to shut up.

Given that Trump is Cohen's only client, what he's been doing for the President is obviously of interest to the Justice Department and criminal prosecutors in the Manhattan division of the U.S. Attorney's Office. (Special Counsel Robert Manafort is only tangentially involved with this particular matter and it's not part of his separate special criminal investigation into Trump and his associates.)

This paragraph in the linked Reuters article is of particular interest:

"Investigators were also looking into whether there was a broader pattern of tax fraud, wire fraud, tax evasion, money laundering and other crimes in Cohen’s private dealings, including his work for Trump and some real estate transactions that involved Russian buyers and prices that appeared to be well above market values."

Holy hell. This suggests that Cohen's files reveal the true smoking guns that could bring Trump to his knees. These would be crimes that have nothing to do with being President -- this would all be potential criminal activity involving his personal businesses.

Early next week, a federal judge will likely rule if any of the seized Cohen material is protected. Attorney-client privilege is not absolute and does not protect ongoing criminality involving both a client and the attorney. And, given the Justice Department's claim that Cohen isn't even really acting as Trump's attorney, but a co-conspirator who happens to have a law degree, the judge might allow everything to be seized.

This is something that definitely will need to be watched for new developments. Stay tuned.

A Higher Loyalty

On Sunday, The New York Times will publish a review of former FBI Director James Comey's new book about his dealings with the Trump administration before he was abruptly fired for, what many believe, refusing to back down to Donald Trump's pressure to drop all criminal investigations into him and his associates. Comey's book goes on sale next Tuesday.

The book review is already available online (link here) and it's effusive in its praise. It also offers the first substantive peek at Comey's side of the story.

And it's gripping.

Comey pulls no punches. He compares Trump to a mob boss and says his administration is run like an organized crime family. The reviewer notes:

"Decades before he led the F.B.I.’s investigation into whether members of Trump’s campaign colluded with Russia to influence the 2016 election, Comey was a career prosecutor who helped dismantle the Gambino crime family; and he doesn’t hesitate in these pages to draw a direct analogy between the Mafia bosses he helped pack off to prison years ago and the current occupant of the Oval Office."

Comey describes an early meeting with Trump in the White House and how it reminded him of his dealings with the mob when he was a prosecutor: "The silent circle of assent. The boss in complete control. The loyalty oaths. The us-versus-them worldview. The lying about all things, large and small, in service to some code of loyalty that put the organization above morality and above the truth."

Wow.

The review offers a lot more. Don't miss it. I'll close with this succinct point from the piece:

"The central themes that Comey returns to throughout this impassioned book are the toxic consequences of lying; and the corrosive effects of choosing loyalty to an individual over truth and the rule of law."

It will be interesting to see more press coverage of the book next week as Comey begins making the interview rounds and journalists mine the pages for details. Stay tuned.

Good Riddance

Speaker of the House Paul Ryan announced he's not running for re-election this year and will leave Congress when his term expires in January. Republicans in the House of Representatives are already jockeying to see who will replace him in the next few weeks or months.

During the 2016 campaign, Ryan did speak out against Donald Trump a number of times and withdrew his endorsement. But once Trump was elected, Ryan's backbone dissolved and he deteriorated into a boot-licking toady who repeatedly groveled in front of the President. Both headed an equal branch of the government, but you'd never know that from the obsequious way Ryan acted.

The media postmortems on Ryan were quick and pulled no punches. My favorite is from Paul Waldman at The Washington Post who wrote an excellent piece with the stinging title of "A scam of a party says goodbye to its top fraud" (link here).

Trump may think Ryan's departure is good news because he thinks he's "winning" the Republican Party. The reality is that the GOP is a diseased, festering corpse of a party. Some prize.

Republicans in Congress are now panicking with Ryan's departure and some are not-so-privately saying to the media they'll lose as many as eighty seats in this fall's election. While that may seem unrealistically high, the chances of the Republican Party maintaining control of the House now seems tiny and even their chances in the Senate are growing clouded.

If a large blue wave comes, as many expect, and Democrats win a sizeable majority in the House and even possibly a small one in the Senate, Congress will make life holy hell for Trump. So he may think he's won with Ryan's departure, but this could be a case of Trump winning the battle but then badly losing the war.

Democrats now have the momentum. This is our chance to curb Trump by seizing congressional control from the GOP. The way to do that is making certain your voter registration is up to date and that you volunteer for a campaign in your state to bring this victory home.

And, of course, you must vote, and make sure everyone you know who's eligible does as well.

The Man From Ukraine

The New York Times broke the story on Monday (link here) that Special Counsel Robert Mueller, as part of his criminal investigation of Donald Trump and associates, is paying close attention to a 2015 deal where Trump's foundation was paid $150,000 by a wealthy Ukrainian steel magnate for a twenty-minute speech on a video feed that was delivered badly and scarcely received any attention at the time.

Photographs from the event show Trump speaking as if on television whilst diners largely ignore him and chat amongst themselves. The Times noted the "awkward nature of Trump’s delivery" and the fact that "he repeatedly stopped speaking, apparently believing he had to pause to give translators time to relay what he was saying."

A former senior Internal Revenue Service official is quoted in the article as noting the payment "is curious because it comes during a campaign and is from a foreigner and looks like an effort to buy influence."

In short, Mueller apparently is trying to determine if this was an illegal foreign campaign donation disguised as a speaking fee, given $150,000 for a clumsy twenty-minute speech is absurdly high. The fact that Trump's lawyer -- the one raided by the FBI -- first solicited the fee only after the speech was delivered.

If Trump was a seasoned candidate with half a brain, he would have turned the money down. Given he's so exceedingly greedy and doesn't think about the possible consequences of his actions, he obviously did not decline the payment.

It will certainly be interesting to see if this eventally leads to any charges. Stay tuned.

The Raid

Yesterday was a big news day. The New York Times broke the fast-moving story that FBI agents raided the Manhattan offices of Michael Cohen, Donald Trump's longtime personal attorney (details here). Some of the documents seized involve payment of hush money to pornstar Stormy Daniels.

Vanity Fair broke the story a few hours later that FBI agents also raided Cohen's Manhattan hotel room (link here).

Special Prosecutor Robert Mueller, currently conducting the criminal probe into Trump and his associates, found evidence of felony violations outside the scope of his investigation. The matter was then referred to federal prosecutors in the New York area for investigation and prosecution, who then applied for warrants for yesterday's raids.

Shortly thereafter, the Washington Post broke the story (link here) that Cohen is being investigated for illegal campaign contributions and bank fraud.

Rather than remain silent, once again Trump opened his yap and wailed about how these were not lawfully executed raids (details here). Many of the subpoenas and other necessary documents were approved by a variety of federal judges, all appointed by Republicans.

Trump claimed FBI agents "broke into" Cohen's offices and that the raid was "an attack on our country." Both claims are blatant lies.

Get over yourself, Donny. When you break the law, you have to pay the price. Lawfully executed search and seizure warrants are not an attack on our country. They're an attack on your criminality.
