Biting Back

Former CIA Director John Brennan revealed on Sunday in an interview that he's considering suing Donald Trump for his vindictive revocation of his security clearance (details here and here).

I hope he does. While I think Trump may ultimately prevail in such an action because courts traditionally have steered wide of reviewing security measures, absent an extraordinary case, but because I think Brennan's potential lawsuit would shine a brighter light on the President's incompetence, recklessness, and willingness to put petty spite before national security. Such a suit could also highlight how Trump himself is both a national security risk with his own careless behavior and also because of his dubious history and connection to criminality.

While Trump is famously litigious, he's equally famous as a terrible litigant. He's often driven by spite and an inferiority complex and thus tends to make strategically bad choices when his legal matters head into court.

He wins battles but loses wars in court. Brennan's suit could bring another spectacualar disaster for Trump. Bring it on.
