Hypocritical Projection

Yesterday, the New York Times broke a startling story (link here) about Donald Trump's previously unreported business and bank dealings in China.

Some major revelations in the article include:

— Trump pays the Chinese government more in taxes than he pays the US government.

— Trump holds at least one previously undisclosed bank account in China that was not reported to the US government as required by law.

This is in addition to media revelations earlier in the year about how Trump owes more than $60 million to a Chinese bank owned by the Chinese government (details here).

Trump has tried to claim that, if elected, Joe Biden would be soft on China. But Biden has no business dealings with China, pays no taxes to China, no bank accounts there, and no loans owned to the Chinese government, unlike Trump.

And let's not forget that Trump has repeatedly praised the Chinese government for their handling of the Covid outbreak (details here) and has also praised China's dictatorial president for extending his term in office "for life" (details here).

Once again, Trump has criticized an electoral opponent for something that's actually Trump's own weakness — a classic example of hypocritical projection.

Oh the Outrage

During one of his vanity rallies on Sunday, Donald Trump mocked how his electoral rival Joe Biden would deal with the Covid-19 epidemic were he to be elected President: "He'll listen to the scientists!" he said in stunned disbelief (details here).

Imagine that! He would actually listen to experts who knew what they were talking about — medical doctors and epidemiologists and virologists! Oh, the outrage!

In short, Trump was contemptuous that Biden would choose the responsible, reasonable, and smart way to attack a problem. As opposed to the improvised, contradictory, disorganized, directionless, seat-of-your pants, grossly inept strategy Trump has bungled his way through.

Trump tried to argue that Biden's approach would drive the country into a severe recession. When in fact it was Trump's duck-and-blame-and-lie approach this year that drove the country into a severe recession. And things once more are getting worse, with Covid infections rising yet again and layoffs increasing.

As he has done many times before, Trump opened his mouth and proved to be his own worst enemy.

The Devil's Bargain

I've said here before more than a few times — and will say it once again now — when a conservative Republican condemns Donald Trump, then everyone should pay attention to what he or she says.

Yesterday, Peter Wehner wrote an excellent piece for The Atlantic (link here) about the literal Devil's bargain that evangelical so-called Christians made with Trump. Wehner was a speechwriter for three Republican Presidents (but not the current one).

Trump is the least Christian of any major American political figure in history. He has repeatedly, in front of many witnesses over a number of years, openly mocked evangelicals as soon as they're escorted out of his presence. He mocks evangelical Michael Pence, his Vice-President, openly to his face.

Yet they have embraced him because he has delivered what they want: conservative judges. They're so desperate to put Bible reading back in schools, to ban abortion, to outlaw same-sex marriage, to legalize overt LGBT discrimination, and to even criminalize LGBT sexual orientation that they literally embrace a man who has far more in common with Satan than with Jesus Christ.

They pretend not to notice this as they bask in his hate, his racism, his blasphemy, and his hypocrisy. This passage from Wehner is particularly on point:

"Moral character in public officials matters quite a lot when the public officials who morally fail are Democrats; it matters hardly at all when they are Republicans. If it’s a liberal who has crossed ethical lines, emphasize righteous conduct; if it’s a conservative, emphasize forgiveness and verses like 'Judge not lest you be judged.' If it’s Bill Clinton in the dock, savage him; if it’s Donald Trump, savage his critics."

In other words, be raging hypocrites.

The Recusal Question

Donald Trump has already made clear his intent to contest the outcome of next month's election should he lose.

While there is no legal requirement for an incumbent candidate to concede before his or her replacement is sworn into office, Trump has also repeatedly said in public statements that he's counting on judges he's nominated to throw the election to him once he takes the matter to court, in particular his newest Supreme Court nominee, Amy Coney Barrett.

That may be empty bluster, given judges have a long history of often ruling against the President or governor who appointed them. Still, Senators had the issue in mind when they questioned Barrett this past week in Judiciary Committee hearings.

Would she recuse herself if a 2020 election case came before her where Trump was a litigant, she was asked? She did not answer.

However, a retired federal appellate judge, writing a piece appearing yesterday in the Washington Post (link here), states that a 2009 Supreme Court precedent all but compels her to recuse should any election action in which Trump is a party come before the high court.

In ruling that a state supreme court justice should have recused himself from considering a matter involving a campaign donor, the Supremes found the mere possibility of impropriety, not actual proof of it, is all that matters.

"The question for Barrett, if it arises, will not be whether she personally believes she can be fair in deciding an election case but, rather, whether a reasonable person would conclude that her impartiality would be inescapably overborne by the flood of influences brought to bear on her," the judge writes.

Several Supreme Court justices, both present and past, have made it known they deeply regretted their involvement in the 2000 presidential election litigation and, in hindsight, wished the high court had just refused to consider the matter, given the subsequent harm it did to the court's reputation.

Indeed, the current justices will be mindful of that if any presidential election matter comes before them again. The Chief Justice, as well as some of the more veteran justices, will realize that if it appears they threw the election to Trump, it will forever badly tarnish and deeply damage their lasting reputation and effectiveness.

As a result, they might decline to take up any such case or, alternatively, judicial peer pressure will compel Barrett — and possibly Trump's two other nominees — to recuse themselves from any consideration of the matter.

Feet to the Fire

On Wednesday night, Donald Trump appeared in a town hall on NBC. The event was hastily scheduled at the last minute with Trump attempting to pull coverage away from his electoral rival Joe Biden, whose own town hall on the ABC network that had been scheduled nearly two weeks ago after Trump backed out of the debates.

Instead of besting Biden, however, Trump's event saw him facing a ruthless grilling like he's never had before. His deranged, haranguing performance was a stark contrast to Biden's measured, reassuring appearance.

Some commentators have contrasted Biden with seeming warm and reassuring like Mister Rogers while Trump came across like a psychotic crazy uncle.

Trump possibly thought his appearance would be a softball interview, given the moderator was Savannah Guthrie, a host on the safe and sugary Today show. If so, he failed to do his homework, because Guthrie was a highly successful and ruthless litigator before she became a journalist.

Rarely has a journalist stood up to Trump like Guthrie did on Wednesday night and never for a extended period of time like she was able to do. If only more journalists had done this when he was first running for office.

Not surprising, of the uncommitted voters in the audience surveyed after the event, not a single one said they were now voting for Trump. As one Republican pollster said yesterday, every time Trump opens his mouth, he loses more voters.

Complacency Kills

Donald Trump has done very badly in election polling over the last several months and increasingly so lately. He's been polling much worse than 2016. That's reassuring.

At the same time, placing too much hope in polls can be dangerous. It can lead to complacency among those who oppose Trump. They become convinced he can't win, so they don't make it a real high priority to vote.

This happened in 2016. Hillary Clinton won the popular vote by nearly three million. But she lost the Electoral College vote because Donald Trump won a razor-thin margin in three states by less than one percent.

Surveys after the election showed that as much as 2 percent of the likely voting population, those who usually vote, did not vote because they assumed Clinton would win.

In other words, they killed her campaign with complacency. Had 2 percent more of her supporters shown up to vote, those who had intended to vote all along for her, she would be President today and no doubt infinitely better at the job than Trump.

Don't let this happen again. Don't run errands or watch something on TV or meet up with friends instead of voting.

Make voting the highest priority of all. Skip work if you have to. Skip class if you have to. Change appointments if you have to. And vote no matter what.

Fizzle

Yesterday, Donald Trump's campaign and his various allies were clutching their pearls over "a major scoop" they were certain would shipwreck Joe Biden's campaign with an "explosive October surprise."

By the end of the day, the bombshell-that-never-was died a quiet, miserable death after a flurry of factcheckers at legitimate media outlets ripped it to pieces.

Early yesterday morning, the stridently pro-Trump tabloid New York Post breathlessly "broke" what they hyped as email "proof" that Biden had met with a Ukrainian he has said he never met. That was supposed to be proof positive that Biden pressured Ukraine into doing him and his family favors.

The tabloid admitted shortly after going to press that they'd never actually seen originals of the emails so no headers could be checked. Worse still, the images of the supposed emails they used to illustrate their "scoop" were obviously Photoshopped and badly so because the resolution in one part of an image doesn't even match other parts of the same image.

The provenance on the emails is equally laughable. Supposedly they came from Biden's son's laptop that an unknown person left in a computer repair shop in Delaware, run by a blind man who also happens to be a manic conspiracy theorist and major Trump booster.

The computer shop supposedly never bothered to get contact information from the person who allegedly dropped off the laptop for repair and then never bothered to pick up. What sort of repair shop does that? And who actually fixes the computers, given the place is owned and run by a blind man? When he was interviewed later in the day, the man spoke incoherently to actual reporters as he ranted and raved about various conspiracy theories.

From him, the contents of the laptop supposedly made their way to the tabloid via Trump's former campaign manager, the now indicted Steve Bannon, and Trump's personal attorney, Rudy Giuliani. And better yet, the "scoop" was written for the tabloid by one of Sean Hannity's producers. As you probably know, Hannity is a Fox News personality who is closer to Trump than his undershorts.

The only people fooled by this clumsy garbage are people who are already planning to vote for Trump anyway.

The Conspiracy That Never Was

Donald Trump has asserted throughout his presidency that officials in the Obama Administration "illegally spied" on him and his campaign in 2015 and 2016 in "the greatest scandal in American history," but that "the truth" would soon be made public.

One of the cornerstones of this supposed scandal was the fact that federal law enforcement agencies were monitoring telephone contacts between representatives of Russia's government and people working for Trump's campaign. As part of that process, certain senior members of the Obama administration inquired whom on the campaign was speaking to Russian officials.

This is known as "unmasking." For instance, evidence shows that Russian X from the embassy is speaking with various Americans associated with Trump's campaign. The senior administration officials asked that the Americans be "unmasked" so they knew their identities. (One of those was Michael Flynn, who later was briefly Trump's National Security Advisor and who pleaded guilty to lying to the FBI about his Russian contacts.)

This is standard operating procedure whenever you have Americans dealing closely with intelligence operatives for a hostile nation with whom the United States has an adversarial relationship. That's because possible crimes can be revealed.

But Trump tried to make this unmasking like it was the crime of the century. Some time ago, he even bullied the Justice Department into opening an investigation.

On the campaign trail, particularly recently, he has hyped this as the greatest scandal in American history that's just about to break wide open any day now.

As if. Yesterday, the investigation quietly folded, having found no evidence of wrongdoing or that laws were broken. Everything was so by the book that they didn't even issue a report (details here).

In short, it was the scandal that never was.

Don't expect Trump to stop talking about this. When facts don't support the narrative, he'll just make things up and lie through his teeth.

Blunt Talk

Senate Judiciary Committee hearings began yesterday for Donald Trump's most recent nominee to the Supreme Court. Given the GOP-controlled Senate refused to even consider President Obama's nominee nearly a year before an election but now will do so a mere two or three weeks before an election is the height of hypocrisy.

Unfortunately, Republicans hold all the cards with this nomination. Democrats have no real means to stop it.

But.

One option they do have, if Democrats win both the White House and control of the Senate in November, is to enlarge the Supreme Court from nine to eleven or even more seats.

Republicans call this "court packing." Some Democrats have taken to use that phrase, too, but as writer/publisher Josh Marshall wrote yesterday at Talking Points Memo (link here), those on the left need to stop using that expression. His piece is titled "It’s Not ‘Court Packing.’ Don’t Be A Moron and Call It That."

He makes the very solid argument that Republicans have been the ones engaging in court packing for the last four decades at all three levels of the federal judiciary. They are attempting to force America to live under a de facto theocracy, where their extremely conservative minority viewpoint is what controls the much larger majority.

Some 70 percent of Americans support a woman's right to choose and some 80 percent support same-sex marriage. So why should the federal court system be dominated by far-right conservatives determined to reverse bedrock precedents like these?

Changing the size of the Supreme Court and the lower federal courts would undo the damage caused by extreme Republican court-packing partisanship and level the playing field.

The Supreme Court size has been changed nine times in the past. There's no reason it can't be done again. The same holds true for the lower federal courts.
