One of Donald Trump's major selling points for his proposed southern border wall is that it would stop most illicit drugs coming into the United States. He has repeatedly -- and falsely -- inferred that most illegal narcotics enter the United States overland, carried by illegal immigrants.

The reality is that almost all drugs come in through legal points of entry -- by vehicle, by train, and by watercraft. The majority of heroin brought into the United States comes through the southern border, but more than 99 percent of that enters through legal points of entry (details here).

Other drugs come primarily by sea and, of course, come in no where near the southern border. That point was well illustrated yesterday when federal authorities seized more than sixteen tons of cocaine in Philadelphia's port, more than a thousand miles from Mexico's border.

It was a record haul for that part of the country and has a street value of more than a billion dollars. And, of course, a southern wall would have done utterly nothing to stop it.

Trump's proposed wall is a fifteenth century solution to a twenty-first century problem. Further, one of the big selling points, that it will nearly stop the flow of illegal and dangerous drugs, is a gigantic lie.

Major Legal Development

The Supreme Court issued a decision yesterday in a case with direct implications for Donald Trump and all those associated with him. The case involved what is known as the separate sovereigns doctrine, and the court affirmed that someone may be prosecuted in both state and federal court for the same offense (details here, here, and here).

While neither Trump nor anyone associated with him was party to this particular suit, the high court ruling does mean that the President and anyone in his circle can be charged with and prosecuted for state crimes, thus leading to possible imprisonment if convicted. Even though Trump, as President, could pardon anyone in his family or associates for federal crimes, he would be powerless to stop or reverse state crime convictions and punishment.

Trump himself is strongly suspected of having committed loan fraud by inflating his earnings and net worth, a possible crime that can be both prosecuted in federal court and state court. While it is legally uncertain if he can pardon himself, a subsequent President could, but that would only apply to federal crimes. He could therefore still be prosecuted in state court for loan fraud and, if convicted, sent to state prison.

Had the Supreme Court overturned the separate sovereigns doctrine, as many feared, a federal pardon would likely prevent most state prosecutions. And in a curious twist of fate, one of Trump's nominees on the high court voted to uphold the separate sovereigns doctrine.

Trump crowed when he was elected that his presidency would be one of many firsts. How ironic it would be if he was the first President to end up in prison, and yesterday's Supreme Court decision makes certain that could actually happen.

In the Dark

On Saturday, the New York Times broke an interesting story (link here) about how the Pentagon has been aggressively hacking Russia's power grid to curb that country's attacking attempts in the United States.

Within the article is this most interesting revelation: Two administration officials revealed how Donald Trump "had not been briefed in any detail about the steps to place 'implants' -- software code that can be used for surveillance or attack -- inside the Russian grid. Pentagon and intelligence officials described broad hesitation to go into detail with Trump about operations against Russia for concern over his reaction — and the possibility that he might countermand it or discuss it with foreign officials, as he did in 2017 when he mentioned a sensitive operation in Syria to the Russian foreign minister."

In a sentence: the Pentagon can't trust Trump out of fear he'll blab national security secrets to Vladimir Putin or some other Russian official. The law does not require them to notify the President about their cyber actions so they didn't bother.

Essentially, the Pentagon is saying a possible Russian intelligence asset is sitting in the Oval Office.

Not surprisingly, Trump completely lost his shit on Twitter about this article. He then contradicted himself by claiming the newspaper committed treason by reporting the story and that the story was not true.

The Trump people rushed a new excuse to the media. The poll was "ancient" they declared. But it's actually only two months old and other national polls show Trump's numbers have slipped since then.

The Trump campaign then announced new polling showed Trump winning easily. But they refused to share those polls with the media.

Yet they expect us to believe them.

The Drums of War

Donald Trump's national security advisor John Bolton is a major warmonger. He was all for the Vietnam War but avoided being sent into combat by serving with the national guard, which was almost never sent overseas in that era.

During George W. Bush's administration, he was a big supporter of the disastrous Iraq War. He also wanted the United States to take proactive military action against Cuba because of claims that they were developing biological weapons, something that turned out to be complete fiction.

And now, as Trump's national security advisor, he's itching to go to war with Iran. Trump himself seems enamored of military action and shows no hesitancy to take military action against Iran.

You may have heard in recent days about two oil tankers explosions on a Japanese and a Norwegian oil tankers in the Gulf of Oman. Soon after the attacks, before there was any solid intel, the Trump administration blamed Iran. The Japanese shipping company that owns the damaged tanker disputed that claim.

Against this background, NBC published an excellent piece yesterday (link here) with the title "Trump blames Iran for the tanker attacks. But let's be skeptical of his administration's pro-war bluster."

This excerpt says it all: "the speed in which the Trump administration officially blamed Iran should give us pause, given John Bolton’s long history of fabricating intelligence in favor of war. The mere process of gathering evidence — let alone conclusive evidence — of how the attack on Thursday was conducted and who was behind it would take days and weeks, not hours."

Begging for Collusion

After tweeting hundreds of times that there was "no collusion" between his campaign and Russia in 2016, notwithstanding more than 250 contacts with Kremlin-connected individuals, on Wednesday Donald Trump said in a televised interview on ABC that there was nothing wrong with accepting incriminating dirt about his election opponent from Russia or other countries and that he'd do it again in 2020 (details here and here.) He also said he saw no reason to contact the FBI.

No surprise, Trump is wrong on the law here. While "collusion" is not a crime, conspiracy is a felony as is accepting things of value from foreign nationals, including opposition research.

Not surprisingly, Trump's remarks set off an immediate firestorm of reactions from both Democrats and Republicans who condemned what he said. Multiple legal experts on both the left and right said as well that the statement alone was grounds for impeachment.

What kinds of aftershocks will this statement produce? Time will only tell. Hopefully Democrats in the House of Representatives pick up on this and use it against Trump.

At a minimum, Trump's 2020 election opponent should use it over and over again against him because it shows Trump has no moral compass and puts self enrichment before national security.

Another Crack in the Wall

Yesterday, the House Judiciary Committee announced that Hope Hicks, former senior aide to Donald Trump who worked closely by his side from before he even ran for President, will testify next week (details here and here). She is the first Trump aide to testify.

The President has attempted to use "executive privilege" to block all employees, current and former, from either appearing as witnesses or responding to subpoenas in any House inquiry. As this development shows, in addition to the Justice Department turning over documents in response to a subpoena, some cracks are starting to appear.

But the stonewall largely continues. Just yesterday, the White House once again evoked "executive privilege" to block release or testimony about a controversial proposal to add citizenship questions to the census (details here).

Leaked Republican research has revealed that the questions were actually designed to suppress non-white and Democratic participation (details here). The matter is currently the subject of a case now before the Supreme Court.

By constantly exerting executive privilege like this, Trump runs the danger that a court will severely trim this practice, thereby severely weakening the President. Richard Nixon tried this strategy and it both failed him and led to his resignation.

So we're not out of the woods with this, in what really is a constitutional crisis. More developments will be coming, particularly in litigation. Stay tuned.

The Whisper Campaign

It's no secret that the Fox News channel is nothing short of a propaganda outlet for Donald Trump. Their exhaustive coverage is slavishly laudatory and often either wrong or deliberately deceptive or outright fabricated.

So it came as no real surprise on Monday when the Daily Beast broke the story (link here) that Fox News has begun pushing the unfounded claim that Joe Biden has health problems. This is because Biden may be the Democratic nominee for 2020 to challenge Trump, and current reliable polls uniformly show him defeating the President if the election was held today.

Fox and Trump -- and Russian-funded trolls and bots -- tried this same tactic with Hillary Clinton in 2016. These false claims included that she had a brain tumor, Parkinson's, cancer, you name it.

One need only look at a current picture of Biden and see he's obviously far healthier than the clinically obese Trump. In contrast, while Clinton was generally in good health, she did have a few scares, like fainting on a hot day when she had pneumonia and tumbling down steps. Biden, however, is not one to do that and looks lean and strong and robust.

There's no way of knowing if Trump has anything to do with inspiring the Fox personnel to conduct this smear campaign. But you can be assured that once the campaign is in full swing, he'll likely join in repeating this lie in various permutations.

A Very Messy Gangbang

They Blinked

Yesterday, the Trump Justice Department agreed to supply the House Judiciary Committee with subpoenaed materials relating to Robert Mueller's investigation (details here). In short, this means they blinked and then caved.

In exchange for the Justice Department's cooperation, the House of Representatives will table the vote to hold Attorney General William Barr in contempt for ignoring their subpoena. This is a purely symbolic gesture and the House gave up nothing of value in return for valuable evidence.

Apparently the prospect of Barr being held in contempt was the motivating factor behind the Justice Department's surrender. It's a mystery why that was so important to them, given that such concerns have not worried other Trump administration officials, but one should not look a proverbial gift horse in the mouth.

Here's to hoping the surrendered material results in evidence of value and this didn't turn out to be just a game of brinkmanship.

They Need to Meet
