A New Era Begins

America has a new President-elect. The vote count progressed far enough late yesterday morning where it became clear Joe Biden had won.

It's no surprise that the egomaniacal soon-to-be former President refuses to admit he lost. He and his defenders continue to insist, without offering a shred of evidence, that massive voter fraud was committed.

That is irrelevant. The various court actions he has brought, lacking in evidence, will amount to naught. His refusal to accept defeat does not matter because the process of finalizing the election proceeds and inaugurating the new President without him.

The nation can now begin to heal from the horrendous failures and corruption of the current administration. President-elect Biden's victory speech was an eloquent call to action for all of us. You can read it in its entirety here.

Endgame

It is now all but certain that Donald Trump has lost the presidential election. Five states remain to be called, and Joe Biden leads in four of them. His popular vote margin has passed four million and continues to grow.

Trump's advantage in Pennsylvania vanished early yesterday as Biden took the lead and that continued to grow through the day. Nearly all the uncounted votes are in counties with a strong Democratic tilt, thus rendering the chance that Trump could grab the lead all but impossible. Winning Pennsylvania alone would give Biden enough electoral votes to take the presidency.

In Georgia, Biden's small lead also continued to grow yesterday. The count there is nearly completed; what remains is mostly in Democratic-leaning counties. A recount will likely be ordered because of the close margin, but historically they have never changed more than a few hundred votes and Biden leads by well over four thousand.

In Nevada, Biden's lead also continued to grow yesterday. The remaining votes are, once again, primarily in Democratic-strong counties. Biden's lead is wide enough that a recount would not happen. And in Arizona, Biden's advantage over Trump narrowed somewhat yesterday, but Trump is not catching up at a rate that would allow him to take the lead.

Trump almost certainly will not concede. I haven't bothered to write about his rantings and ravings since the election because he's increasingly unhinged and irrelevant.

But a concession isn't necessary as a matter of law. The mechanism for inaugurating our new President will function without him.

So will have to sit tight for now. The race could be called tomorrow and then again it might not be. But it will be soon.

The vote count continues. As of this writing, Joe Biden leads Donald Trump by a bit over a thousand votes in the state of Georgia.

If you voted absentee in Georgia, you can check online to see if your ballot was successfully accepted. If not, you can fix it, but only if you act today. Click here to learn more.

Biden leads Trump by a little over eleven thousand votes in Nevada and forty seven thousand votes in Arizona.

A Clearer Picture

A day later, a lot more is known about the outcome of Tuesday's election, and it's all bad news for Donald Trump.

More states have been called for Joe Biden but none for Trump. Biden leads in two of the five states yet to be called. His popular vote lead is closing in on 4 million.

If that holds, and there's good reason to believe it will, he wins 270 electoral votes and the presidency.

That leaves three other states. Trump leads in all three but his lead keeps shrinking as more votes are counted. These are almost entirely mail-in votes, and those are breaking 70 to 75 percent for Biden.

In short, Biden has several potential paths to victory. Trump has almost none.

Trump has already filed suit to stop the count in some states. Legal experts nearly universally agree the filings have no chance (details here, here, and here).

You need grounds to be able to sue someone successfully over election matters. Simply being a sore loser is not sufficient.

Some of the remaining five states yet to be called will take several more days or longer because they can count votes received after election day as long as they are postmarked on or before November 3, 2020. So we all have to sit tight and wait.

Red Mirage in Progress

I'm posting this at midnight in California and the race is nowhere near to being called yet. Trump has a deceptive lead in key swing states because little or no mail ballots have been counted there.

So far, only 25 percent of Pennsylvania mail votes have been counted, 20 percent in Michigan, and exactly none in Wisconsin.

As of this moment, Joe Biden is doing well in both Arizona and Georgia, both of which Donald Trump won in 2016. In Georgia, mail ballots in Atlanta are still being counted.

Biden, of course, is leading in the popular vote. But the Electoral College is what counts.

So this will almost certainly be several days or even a week or more before it's final. It's not over until all ballots are counted. Pennsylvania, Michigan, and Wisconsin will likely be key.

Hang tight.

Two Important Election Matters

First, if you are voting in person today and experience any problems or have questions, call the National Voter Protection Hotline at 1-833-336-8683. You can also visit their website (link here) for help finding your polling place, a ballot drop-box, checking your registration, and more.

Second, when watching the election returns tomorrow night, beware of the possibilities both of a red mirage and of a blue mirage — election returns in one swing state or another may appear to go strongly to one candidate with the count well underway (details here). Don't be fooled by that, because different types of ballots are counted at different times in different states.

The massive number of people who voted absentee, early, and by mail this year may complicate and slow ballot counting and give a "mirage" vote even with a significant percent already counted. Donald Trump has made it known he plans to declare himself the winner tonight if he appears to be ahead early; ignore him. He has no say on who the final winner is; that's up to each state.

The final result may not be determined for several days, particularly if the totals are close. Some states, like Pennsylvania, may seem unduly slow. Just be patient. Post-count litigation is also very likely and may complicate matters.

Vote and then sit tight. It may seem like a long counting process this year but don't panic. It's not over until every vote is counted.

A Simple Question

Tomorrow is election day. If you've not already voted and are still undecided, or you know anyone who is still undecided, ask this question: are you better off today than you were four years ago?

The answer almost certainly is a resounding "no." America is sicker, weaker, more indebted, more beleaguered, more divided, and mired in high unemployment and worsening recession.

Why would anyone possibly think about voting for the man who is chiefly responsible for many of these problems and more?

The man up for reelection was hired four years ago to make life better for you and me and America. And he has failed miserably at that job. Why would anyone consider extending his contract for four more years?

Things got a lot worse for nearly all of us these last four years. Now imagine how much more horrible they will be if the man responsible is allowed to remain in office. He failed miserably. He should not be rewarded with a second term.

Vote. Him. Out.

A Load of Bollocks

Hopefully, Donald Trump will be soundly defeated next Tuesday and be gone in January. Unfortunately, the judges and justices he nominated will remain on the bench for many years to come.

Without exception, they all adhere to an extreme conservative legal theory known as "originalism." This is a form of magical thinking where judges decide what was in the minds of the men who wrote the Constitution.

Using originalism as a club, conservative judges have overturned countless progressive laws with their magical originalist wand.

Last week, Maine Senator Angus King, who is neither a Republican or Democrat, wrote an excellent shorter piece for The Atlantic (link here) that says quite eloquently that originalism is a load of bollocks.

That results in a Constutution, as King writes, which is "a derelict sailing ship locked in the ice of a world far from our own."

While fifty-five men signed their names to the Constitution in 1787, it was primarily written by James Madison, who famously said on more than one occasion that interpretation of the document should evolve with time. That is a decidedly anti-originalist point of view.

If ever you encounter someone who waxes positively about originalism, show them the linked article as a reply. It is an inconvenient truth they cannot rebut.
