If you haven't done so already, now is the time to contact your Senators and urge them to vote to allow both witnesses and written evidence in the pending Senate impeachment trial. You can find contact information for every Senator here.

These five Republican Senators the are most likely to lose their seats this year: Susan Collins from Maine, Joni Ernst from Iowa, Cory Gardner from Colorado, Martha McSally from Arizona, and Thom Tillis from North Carolina. Calls to each of these Senators should also include a reminder that how they vote in impeachment will be conclusive in winning or losing reelection.

Right now, the question of whether witnesses will be allowed has not been resolved. A vote on that will not come until after the House managers, who act as prosecutors, and the defense present their cases. That's why Senators need to be called now.

Anticipating that witnesses may be allowed, Donald Trump and his staff are striving to keep John Bolton's testimony secret and forcing him to testify behind closed doors (details here). That must not be allowed.

Calls to all Senators should include a demand that all witnesses testify publicly. There is no national security reason to hide Trump's crimes.

Please contact your Senators today. Preventing witnesses and written evidence will turn the trial into a sham. That must not be allowed to happen.

In November, ProPublica published a superb piece of reporting (link here) on Donald Trump's abysmal LGBT record. I missed it back then but it's still very timely and relevant two months later.

The interactive article is titled "Under Trump, LGBTQ Progress Is Being Reversed in Plain Sight." The title deck is "Trump promised he would fight for LGBTQ people. Instead, his administration has systematically undone recent gains in their rights and protections. Here are 31 examples."

The many examples are broken out by topics and each item is multiply sourced.

It angers me that people still believe Trump is the best President ever for LGBT Americans. The reality is that he's the worst President in the modern era for the LGBT community and, by extension, all members of threatened classes in this country.

At Odds with Common Sense

Donald Trump has selected several several lawyers for his impeachment defense team who are best known as TV talking heads on TV. Prominent amongst them is Alan Dershowitz who has represented a number of celebrities in high profile criminal trials, including OJ Simpson and Mike Tyson.

Dershowitz hit a number of the Sunday political talk shows yesterday where he rolled out a new and absurd defense of Trump: "Abuse of power, even if proved, is not an impeachable offense."

A number of prominent attorneys immediately stepped forward and said this was laughably wrong and, in one case, "at odds with common sense" (details here). The linked piece lays out a detailed argument about why Dershowitz is 100 percent wrong.

It's not surprising, however, that Trump's team is peddling this claim. That's because they have no actual defense to the prosecution's case. They're conceding Trump is guilty as charged by putting this forward.

Some of this was because of pressure from big food processing companies. Are some of their execs Trump donors?

But part of the reason was also obvious because of the date the decision was announced. Michelle Obama had been the driving force behind improving school food. And because Trump has steadfastly worked to reverse everything the Obama administration has done, they cut all the programs. And they did so on Michelle Obama's birthday.

Trump's racist heart and bigoted soul still can not get over the fact that a black man was President. So he's worked steadfastly to try and undo the man's legacy.

More Unpopular

The political website FiveThirtyEight published a very interesting piece yesterday (link here) with the provocative title of "Trump May Be Even More Unpopular Than His Approval Rating Shows."

Let's hope so.

The thrust of the piece is that approval is not as binary as it would seem. Someone may still be a Republican and not support any of the Democrats running, but they don't like Trump, either.

So while that person might not turn out in November to vote for the Democratic nominee, he or she won't vote for Trump either, which is a net win for Trump's opponent.

Of course, we should never be complacent about polls. That happened in 2016. We need to act like Trump is ahead and thus get everyone we know to volunteer and vote against him.

Complacency kills.

A Man Named Lev

Against the backdrop of the President's impeachment, Lev Parnas, a former associate of both Donald Trump and his lawyer Rudy Guliani, has given a series of media interviews with explosive revelations (details here, here, and here).

These have resulted in several big takeaways, including that Trump has always been completely in the loop on everything that was happening with the Ukraine extortion scandal and that there were multiple other incidents of Trump and his people squeezing the Ukrainian government for election help.

Parnas is under indictment and some of his claims have not been confirmed. At the same time, he has been providing explosive document releases that are confirmed and suggest he's telling the truth.

Nevertheless, Senate Republicans are pretending he doesn't exist. They may do so at their peril. Jonathan Bernstein at Bloomberg wrote an excellent piece about this (link here).

"Republican senators don't even know what they're covering up for, or at least what they would be covering up for if they follow the White House's preference to rush through the Senate impeachment trial that starts next week and refuse to hear from relevant witnesses and collect relevant documents," writes Bernstein.

For his part, Trump insists he does not know Parnas. And Parnas, angered at that, keeps releasing photos of himself with Trump.

Richard Nixon made the big mistake of treating some of his bagmen like shit. They turned against him. Trump is making this same mistake. Of course, if he read any history, he would know this, but then Trump thinks he's too smart to learn anything.

As one pundit said on Twitter yesterday, "when Trump says he knows everything, he knows nothing. When Trump says he knows nothing, he knows something. And that something is bad."

The process is not yet set in stone for this impeachment but should be within the next few weeks. The biggest question will be whether the Senate will allow for an actual trial with witnesses or whether they want a sham without witnesses.

Polls show that a clear majority of Americans want witnesses at the impeachment trial, so an attempt to thwart that may hand Trump an acquittal but then help Republicans lose control of the Senate with this November's election.

Incoming

Today, the House of Representatives is expected to formally vote to send Donald Trump's two articles of impeachment to the Senate for a trial.

Although House Speaker Nancy Pelosi was criticized by Republicans for delaying transmission of the articles, she appears to have achieved her goal of both preventing summary dismissal of the charges and also of compelling the Senate to allow witnesses in the proceedings (details here).

A failure to quickly dismiss and also inclusion of witnesses both represent significant defeats for Trump. He wanted a sham trial but it does not appear he will get it. The fairer and more objective the trial, the more likely the public will learn about how Trump has repeatedly violated the law.

The chances of the Senate voting to convict Trump and remove him from office have always been small. But that was never really the goal behind the impeachment, I don't believe.

It was all about making public Trump's corruption and incompetence on the biggest stage possible. That now appears likely to happen. The Senate trial is expected to begin next Tuesday. Stay tuned.

Four Embassies and a Liar

In recent days, Donald Trump has repeatedly said that part of the reason he ordered a drone strike on Iranian general Qasem Soleimani was because the latter planned to attack four embassies — not some or a few or three or six but specifically four.

But as Aaron Blake wrote in the Washington Post yesterday (link here), that claim appears to be nothing more than the standard bundle of Trump lies that his underlings have failed to defend. His piece is titled "Trump's 'four embassies' claim utterly falls apart."

The wisdom of striking Soleimani aside, if Trump had any sense, he could have sold the attack to the American people with a succinct statement immediately thereafter and made sure his administration stayed completely on a tight message thereafter.

But, of course, he didn't do that. He played his typical childish Twitter games and retweeted memes and made a whole host of conflicting claims, long after the fact, in an attempt to justify the strike. Rather than appear on national television the night of the attack with a tight statement, he waited days to make a public appearance that was nothing short of a sniffing, slurring, babbling disaster.

As someone who closely followed the action against Osama bin Laden, particularly the public messaging after the fact, it's sobering to watch how badly Trump has bungled what could have been a victory for him. He snatched disaster from the jaws of victory. The whole episode has ably demonstrated Trump's gross incompetence and unfitness for the presidency.

Tuesday Tearoom

Last week, the NPR radio program Fresh Air featured an interview with an investigative journalist who has written about Donald Trump and his extended family for a number of years. The episode is available for free and indefinitely online to download as a podcast (link here).

I highly recommend listening. In the span of forty minutes, the writer succinctly deconstructs Trump with a clarity and focus I've not witnessed any other journalist achieve.

I was left with several thoughts after listening to the program.

One is that a man striving to be an oligarch, as Trump has been doing all his life, is the absolutely wrong kind of person to be President. America is now morphing from a democracy into a plutocracy and Trump will only hasten that transition. It's imperative on all of us to reverse this trend in 2020 and thereafter.

Second is the realization that Trump is like a virus who infects most everyone around him with corruption, including his own children. The only ones who survive this are the ones who escape before he can corrupt them. He's also infected a fair portion of the country. The only cure will be to expunge him from the government.
