Actions Versus Words

Traditionally, when American parents had a child born in surrogacy for them outside the United States, that child became an American citizen. When same sex marriage became legal nationwide during the Obama administration, President Obama extended that policy to same-sex parents of surrogate children born abroad.

When Donald Trump became President, however, that policy was revoked. Even though surrogate children born to straight parents still were automatically made citizens, surrogate children born to same-sex parents were specifically denied citizenship.

A gay couple, where both husbands were born in the United States and thus had birthright citizenship, sued when their daughter was denied citizenship by the Trump administration. They argued that denying citizenship to their child was needlessly cruel and furthered no compelling government interest (details here).

A federal court agreed, ruling against the Trump administration, and granted full citizenship to their daughter. It remains to be seen whether the Trump administration will appeal. If Trump does not win reelection, the incoming pro-LGBT administration undoubtedly will withdraw any such appeal.

Remember when Trump promised to be the best President ever for LGBT Americans? Once again, his actions prove his words were lies.
